Terri Horman details visitation request for daughter Kiara

A motion filed this week asks for supervised visitation with the young girl, and that Kaine Horman pay all the costs associated with the visits.

PORTLAND -- Terri Moulton Horman has formally petitioned the court to give her visitation rights to her daughter Kiara Horman.

In a motion filed Oct. 13, she seeks to amend a restraining order that has prevented her from seeing her 22-month-old daughter since June 28.

Horman is the stepmother of Kyron Horman, missing from Skyline School since June 4. The investigation into his disappearance has captured national attention. The ongoing search for him has been the biggest in state history.

Terri has not been named a suspect in the case but has been singled out by law enforcement since she was the last to see Kyron alive.

She has been publicly ridiculed by Kyron's parents Kaine Horman and Desiree Young several times for not cooperating with authorities, including faring poorly on lie detector tests.

On June 26th, Kaine Horman learned from police that Terri had allegedly tried to hire a landscaper last February to kill him. Kaine then moved out of their rural Northwest Portland home and took Kiara with him.

The couple are now in the midst divorce hearings, delayed until next January, that intertwine a criminal and civil case.

In the motion, Terri's divorce lawyer Peter Bunch says that Kaine had refused repeated requests by Terri to be able to visit Kiara, until a recent divorce hearing when he seemed amenable to supervised visitation.

There should be regular and frequent contact between Kiara and her mother, Bunch wrote.

Terri also argues via her lawyer that Kaine should pay for whatever form of supervision might be granted. He broached the subject, the motion says, and Terri can't pay as she is not employed and has no income or significant assets.

Bunch also argues that Terri cannot speak on her behalf, but an expert could detail to the court how important it is for her to have visitation rights, and that supervised ones can be safe and secure for Kiara.

As the court is aware, because of the ongoing criminal investigations that are focused on (Terri), there are serious issues involved as to (Terri's) ability to assert her custodial and parenting rights.

Copies of the motion were also sent to Stephen Houze, Terri's criminal defense lawyer, and Laura Rackner, Kaine's divorce attorney.
