PORTLAND -- A motorist who claims that an off-duty Portland sergeant pulled a gun on him during a road rage incident has filed a lawsuit against the sergeant and the city of Portland, according to the Oregonian.
The online article said that the lawsuit was filed Friday and Neil Ruffin, 34, was seeking $145,000 in damages from Nice and the city, accusing the sergeant of menaceing and threatening him with a loaded gun.
The road rage incident happened on April 3 in Washington County, near Portland. Both Ruffin and Sgt. Nice called 9-1-1 in separate calls. A woman who said she witnessed the incident also called 9-1-1.

A sheriff's deputy responded and wrote a report but no one was cited. Washington County Sgt. Dave Thompson says his deputy did not feel anyone's conduct rose to the level of a crime. Portland police reportedly were also conducting an internal inquiry.
