Border Patrol captures Canby drive-by suspect

A man wanted in connection to a 2004 drive-by shooting in Canby, Oregon has been arrested by the Border Patrol.

TUCSON, Ariz. -- A man wanted in connection to a 2004 drive-by shooting inCanby,Oregon has been arrested by the Border Patrol.

A spokesman with the Tucson Sector Border Patrol said Rutilio Martinez-Cruz -- a 31-year-old illegal immigrant from Oaxaca, Mexico -- was apprehended by agents assigned to the Casa Grande Station near San Miguel, Arizona. While detaining Martinez-Cruz, agents learned that he was wanted on an active warrant from Oregon.

Canby Police said Martinez-Cruz was a passenger involved in a drive-by shooting in 2004. An investigator said he fired shots at a rival gang member who was sitting on some nearby steps near an apartment complex. The bullets hit the complex, but no one was injured in the shooting.

Martinez-Cruz was booked in the Pima Co., Ariz. jail and is awaiting extradition to Oregon. He's facing a total of 18 charges, including attempted murder and attempted assault.

Another suspect in the case -- Raul Alvarado-Mendoza -- was convicted in 2004 and sentenced to Two Rivers Correctional Institution in Umatilla, Ore. Records show that he could be released as early as October of this year.
